Terms and Conditions of Use
Welcome to the website of the NSW Indigenous Chamber of Commerce at www.nswicc.com.au. These Terms and Conditions ('Terms') govern your use of the NSWICC website, including any subpages (together, 'the Site'). By accessing or using the Site, you agree to be bound by these Terms, which constitute a legal agreement between you and NSWICC. If you do not agree with any of these Terms, please do not use the Site.
1. Acceptance of Terms
1.1 By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.2 NSWICC reserves the right to modify, update or replace these Terms at any time without prior notice. Continued use of the Website after any changes to the Terms constitutes your acceptance of the modified Terms.
2. About NSWICC and these Terms
2.1 The Site, is owned and operated by the New South Wales Indigenous Chamber of Commerce (NSWICC, we, our or us), and its related entities under the domain name www.nswicc.com.au. A reference to the NSWICC in this notice includes any related bodies corporate and related entities.
2.2 These Terms apply alongside our Privacy Policy and any other guidelines, policies or notices referenced on the Site.
2.3 The purpose of this Site is to support NSWICC’s work in advancing Aboriginal and Torres Strait Islander economic participation, business development, procurement opportunities, and community growth across New South Wales.
2.4 Your access and use of the Site is entirely at your own risk.
2.5 You acknowledge that access to some parts of the Site may be provided subject to the acceptance of additional requirements or restrictions to those set out in these Terms. In the event of an inconsistency between these Terms and any additional requirements, the additional requirements will prevail to the extent of the inconsistency.
3. Use of the Website
3.1 NSWICC grants you a non-exclusive, non-transferable, limited license to access and use the Site , subject to these Terms.
3.2 You agree to comply with all applicable laws, regulations and third-party rights while using the Site.
3.3 You are prohibited from engaging in any of the following activities:
- violating or attempting to violate the security or integrity of the Site
- collecting or storing personal information about other users without their consent
- uploading, transmitting or distributing any content that is unlawful, harmful, defamatory, obscene or otherwise objectionable or
- using the Website to transmit any unauthorised advertising, promotional materials or spam.
4. Intellectual Property
4.1 All intellectual property rights in the Site and its contents, including but not limited to text, graphics, logos, images and other creative works and software are owned by NSWICC or its licensors unless otherwise specified or acknowledged.
4.2 Except to the extent permitted by relevant copyright legislation, you must not, and must not permit others to:
- copy, modify, transmit, store, reproduce, republish or adapt the Site or Content
- create any other material using the material on this Site
- distribute, sell or commercialise any part of the Site or Content
- remove copyright notices, branding or proprietary marks, or
- reverse engineer or attempt to extract the source code of any software on the Site
without obtaining the prior written consent of the NSWICC.
4.3 Trademarks (whether registered or unregistered) and logos must not be used or modified in any way without obtaining the prior written consent of the NSWICC.
4.4 The Site, products, technology, and processes contained in this Site may be the subject of other intellectual property rights owned by Us or by third parties. No licence is granted in respect of those intellectual property rights other than as set out in these Terms. Your use of this Website must not in any way infringe the intellectual property rights of any person.
4.5 All rights not expressly granted are reserved.
5. Disclaimer of Warranty and Limitation of Liability
5.1 The Site is provided on an 'as-is' and 'as available' basis, without any warranties of any kind, whether express or implied.
5.2 NSWICC makes no warranties that the Site or Content:
- will be complete, accurate or current
- will always be available or error-free
- will meet your requirements
- is fit for any particular purpose, or
- will be free from viruses or other harmful components.
5.3 All visitors to this website must make their own enquiries and obtain their own professional advice in relation to any issue or matter referred to herein.
5.4 To the maximum extent permitted by law, NSWICC is not liable for any loss, damage, cost or expense (including indirect, consequential or economic loss) arising from:
- your use of the Site or Content
- reliance on any information provided
- interruptions, errors or security issues
- Data uploaded by users, or
- third party material.
5.5 Nothing in these Terms excludes any guarantee, right or remedy that cannot be lawfully excluded under Australian Consumer Law.
5.6 You acknowledge that access to some parts of the Site may be provided subject to the acceptance of additional requirements or restrictions to those set out in these Terms. In the event of an inconsistency between these Terms and any additional requirements, the additional requirements will prevail to the extent of the inconsistency.
6. Indigenous Cultural and Intellectual Property (ICIP)
6.1 The Site may include Aboriginal and Torres Strait Islander Cultural and Intellectual Property (ICIP), including artworks, cultural knowledge, language, designs, stories and other material.
6.2 You agree that:
- ICIP always remains the cultural property of the traditional owners or custodians
- you will not use any ICIP for any purpose without the prior written consent of the relevant custodians
- you will respect cultural protocols and ICIP rights when accessing or sharing Site content.
7. Unacceptable Use
7.1 When using the Site, you must not:
- do anything unlawful, defamatory, abusive, discriminatory or culturally insensitive
- upload or transmit anything that contains viruses, Malicious Code or harmful software
- provide false or misleading information
- interfere with the Site’s security or functionality
- attempt to gain unauthorised access to any account, system or data
- use automated tools (e.g., scraping, bots, harvesting tools) without our permission
- upload content that infringes intellectual property or privacy rights
- post offensive, obscene, harmful or inappropriate material, or
- link to the Site in a manner that suggests affiliation or endorsement where none exists.
7.2 We may remove any content you upload or terminate your access at our sole discretion.
8. User-Submitted data
8.1 If the Site allows you to submit or upload information, business details, comments, images, logos or other material (‘Data’), you:
- grant NSWICC a royalty-free, worldwide, licence to use, publish, display or distribute that Data in connection with NSWICC’s services, programs and activities
- confirm you own the Data or have permission to provide it
- confirm the Data is lawful, accurate and non-misleading, and
- acknowledge we may remove or refuse the Data at any time.
8.2 We are not responsible for verifying or monitoring all Data submitted through the Site.
9. Collection Notice & Privacy
9.1 Your Privacy is a priority to the NSWICC, and your information will be held in confidence by our secure systems and only used for the stated purposes.
9.2 NSWICC may collect personal information from you to:
- provide access to the Site
- respond to enquiries
- deliver programs, services, training or events
- process business or membership information
- maintain procurement-related services
- communicate updates, news and opportunities
- improve our digital experience and service delivery.
9.3 As a peak body established to support the interests of Indigenous Businesses and Enterprising Community Organisations, the NSWICC utilises de-identified data supplied by members from membership applications, periodic surveys and focused research projects to inform Government and Industry Initiatives designed to deliver Business Programs and Procurement opportunities to Indigenous People, Businesses and Communities.
9.4 Personal information may be disclosed as required by law.
9.5 Please review our Privacy Policy for details about how we collect, store, use and protect your information, and how you may request access or lodge a complaint.
9.6 By using this Site, you consent to NSWICC handling your personal information in accordance with our Privacy Policy.
10. Third Party Material
10.1 The Site may include links to websites, services or materials owned by third parties. NSWICC:
- does not endorse or approve third party material
- is not responsible for its accuracy, reliability or legality, and
- is not liable for any loss or damage arising from your use of third-party material.
10.2 You access third party material at your own risk.
11. Indemnity
11.1 You agree to indemnify NSWICC, its directors, employees, contractors and partners from any claims, liabilities, losses or damages arising from:
- your use of the Site or Content
- your Data
- your breach of these Terms, or
- your breach of any law or third-party rights.
12. Termination
12.1 We may suspend or terminate your access to the Site at any time and without notice.
13. Miscellaneous
13.1 These Terms constitute the entire agreement between you and NSWICC regarding your use of the Site and supersede any prior agreements or understandings.
13.2 If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
13.3 The failure of NSWICC to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
14. Definitions
Content
All text, images, graphics, audio, video, documents, tools, data and other material available on or through the Site.
ICIP (Indigenous Cultural and Intellectual Property)
Aboriginal and Torres Strait Islander peoples’ rights to traditional knowledge, cultural expressions, language, stories, art, designs, and other cultural heritage.
Malicious Code
Any software or code designed to harm or interfere with computer systems, including viruses, malware, spyware, worms or trojans.
Data
Any information or material uploaded or submitted by users via the Site.
By using the NSWICC website, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
